The Office of the State Controller recently received a request for approval from the North Carolina Prepaid Legal Services Corporation to include a payroll insert advertising their services in each agency’s monthly payroll. Their request complies with OSC policy; however, we have since been advised that North Carolina General Statute §58-31-60 (Competitive selection of payroll deduction insurance products paid for by State employees) defines a “prepaid legal service” as an insurance product. Under the terms of this statute each state agency offering payroll deduction insurance products is required to have an Employee Insurance Committee – which is responsible for reviewing and selecting which insurance products reflect the needs and desires of employees in their agency.
It is therefore at the discretion of each payroll unit to coordinate with their agency’s employee insurance committee to determine if they desire to make this offering through the payroll insert. Thank you for your attention to this matter.
